Terms of Service

1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of PropertyFrame (the "Service"), operated by us ("PropertyFrame", "we", "us"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you don't agree, don't use the Service.

2. Who can use PropertyFrame

The Service is intended for real estate professionals and others authorized to market a property. You must be at least 18 years old and able to form a binding contract to create an account. You're responsible for keeping your login credentials secure and for all activity under your account.

3. Your listings and content

You retain ownership of the addresses, prices, descriptions, photos, and other content you upload ("Listing Content"). By uploading Listing Content, you grant us a license to host, display, reproduce, and distribute it as needed to operate the Service, including generating the listing website, printable flyer, QR code, and social share cards.

• You represent that you have the right to publish the Listing Content, including any photos, and that it does not infringe anyone's rights.
• You're responsible for the accuracy of pricing, facts, and disclosures on your listing pages. We don't verify listing information.
• You agree to comply with applicable real estate advertising laws and Fair Housing / Equal Housing Opportunity requirements in the jurisdictions where you operate.

4. Visitor leads and inquiries

The Service collects contact information submitted by visitors to your listing pages (through inquiry forms, price-unlock forms, and open-house kiosk sign-ins) and delivers it to you as leads. You are the data controller for that lead information and are responsible for how you use, store, and contact those individuals in compliance with applicable law.

5. Subscriptions and billing

Paid plans are billed in advance on a recurring basis through our payment processor (Stripe). You authorize us to charge your payment method for the applicable fees. Plan pricing, features, and any promotional or admin-granted access are as described at checkout or in your dashboard. You can manage or cancel your subscription at any time from the billing portal; cancellation takes effect at the end of the current billing period unless stated otherwise.

6. Partner referral program

If you participate in our partner referral program, the following additional terms apply.

• Enrollment as a partner is at our discretion and by invitation. Enrolled partners receive a unique referral link/code to share with prospective users.
• A referred signup is tracked when someone creates an account using your referral link. We don't guarantee any particular volume of referrals or that a referral will convert to a paying subscription.
• Commission is calculated as a percentage of what your referrals actually pay us, at a rate and (if applicable) duration cap that we set and communicate to you individually. We may change your rate or cap prospectively at any time; changes don't apply retroactively to commission already earned.
• Payouts are made manually, outside the Service (e.g., by wire, check, or similar), on a periodic basis at our discretion. Your dashboard shows your running balance of commission earned minus payouts recorded.
• When promoting the Service, you must not make false or misleading claims, spam, or otherwise violate applicable law (including FTC disclosure requirements for compensated endorsements). We may suspend or terminate your participation in the program, including forfeiting unpaid balances, for violating these Terms.
• The referral program may be modified or discontinued at any time; commission already earned on payments received before discontinuation remains payable.

7. Acceptable use

You agree not to use the Service to publish unlawful, fraudulent, or misleading content, to infringe intellectual property, to harvest visitor data for unrelated purposes, to attempt to bypass rate limits or security controls, or to interfere with the Service's normal operation.

8. Publishing and removal

Draft listings are visible only to you until you publish them. You can unpublish or delete a listing at any time. We may remove or unpublish content that violates these Terms or applicable law, and may suspend or terminate accounts for material breach of these Terms.

9. Service availability

We aim to keep the Service reliable but don't guarantee uninterrupted availability. Features may change, and we may modify or discontinue parts of the Service with notice where practicable.

10. Disclaimers

The Service is provided "as is" without warranties of any kind, express or implied. Listing information displayed to visitors is provided by you and deemed reliable but not guaranteed; buyers should independently verify all facts.

11. Limitation of liability

To the maximum extent permitted by law, PropertyFrame will not be liable for indirect, incidental, or consequential damages arising from your use of the Service, and our aggregate liability will not exceed the amount you paid us in the twelve months preceding the claim.

12. Changes to these terms

We may update these Terms from time to time. We'll update the "Last updated" date above when we do. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
